Old Laws Apply to New Media
Last month the Tax and Trade Bureau distributed a circular entitled Use of Social Media in the Advertising of Alcohol Beverages. Here are some of the main points for those that haven’t read it on the TTB.gov website.
Advertisers must comply with the FAA Act and TTB advertising regulations when advertising on:
Social network services such as Facebook and LinkedIn
Video sites such as YouTube and Vimeo
Blogs and Microblogs such as Twitter or Tumblr
Links and QR Codes
The requirements include both mandatory statements (responsible advertiser name and address) and prohibited claims (misleading). The circular notes that it is TTB’s position that the in-place regulations cover social media even though they didn’t exist when the regulations were first introduced.
